San Diego divorce lawyers, Michele Lowenstien and Elizabeth Brown, discuss some of the options available for a parent who finds they can no longer meet their child support obligation. The two attorneys explain that as long as the child support order remains in place, the paying spouse is legally accountable for the support. It is important to immediately seek to petition the court to revise and revisit the support order and have it adjusted it to fit the new income.
If you simply choose not to make the due payments, the supported spouse may petition the court in its turn to have it enforced. The court can respond by removing your passport and drivers license, imposing tax intercepts, liens on the home, and ordering jail time. Living in one state while owing delinquent child support in another is a federal crime. Ignoring owed child support is not a solution. If your financial situation has changed it is important that you immediately request a modification from the court, or face severe legal consequences on top of penalties and interest on the already due child support.
